Angelo Life App Terms of Use

Information shown in the App must not be used for medication, treatment, emergency, or other safety critical decisions. These Terms of Use govern access to and use of the Angelo Life mobile application, together with related digital features and services made available by Empaco Healthcare Technologies SRL, a Romanian company with its registered office at PiaΘ›a Unirii 3, TimiΘ™oara, Romania, registered with the Trade Register under number J35/2019/2024 and having tax identification code 46314192, referred to in these Terms as Empaco, we, our, or us.

By accessing or using the Angelo Life App, you confirm that you have read, understood, and accepted these Terms.

If you do not agree with these Terms, you must not use the App.

1. Scope of these Terms

1.1. These Terms apply to the Angelo Life mobile application, its features, content, alerts, account related functions, and related digital services provided by Empaco in connection with the Angelo Life smartwatch and the corresponding service package.

1.2. These Terms apply to users of the Angelo Life service, including:

  • –the Client, meaning the person who enters into the contractual relationship with Empaco,
  • –the User, meaning the person who uses or wears the Angelo Life device or whose data may be visible through the service,
  • –the Designated Person, meaning a person selected to receive alerts, notifications, or related information through the App.

1.3. These Terms govern the use of the App as a digital interface and related digital functionality. The wider commercial relationship, including device rental, SIM subscription, selected services, fees, contract duration, return obligations, and other contractual matters, is governed by the separate agreement concluded between Empaco and the Client.

1.4. If there is any inconsistency between these Terms and the separately signed contract, the signed contract shall prevail to the extent of that inconsistency.

2. Eligibility and authorised use

2.1. The App may only be used by persons who have been authorised by Empaco or by the Client, as applicable, in connection with the Angelo Life service.

2.2. The App is intended only for lawful personal use in connection with the Angelo Life service and may be used only for the purpose for which it is made available.

2.3. You may use the App only if:

  • –your access has been validly created or enabled through Empaco's onboarding process,
  • –you have the legal capacity to accept these Terms or are duly represented,
  • –you use the App in accordance with these Terms, the relevant service documentation, and any instructions made available by Empaco.

2.4. The App must not be used for unauthorised third party access, commercial resale, public distribution, reverse engineering, or any use outside the intended service environment.

3. Relationship with the service

3.1. The App forms part of a wider service ecosystem that may include:

  • –the Angelo Life smartwatch,
  • –a SIM enabled connectivity component,
  • –onboarding and account activation,
  • –monitoring related services,
  • –selected notifications and alerts,
  • –customer support, maintenance, and troubleshooting.

3.2. Access to some features may depend on:

  • –the selected service package,
  • –the status of the contractual relationship,
  • –successful activation of the device and account,
  • –internet access, mobile network availability, and device compatibility,
  • –the device being charged, functioning properly, and used correctly,
  • –permissions granted on the mobile device.

3.3. Nothing in these Terms obliges Empaco to provide services outside the agreed service package or outside the scope of the separately concluded contract.

4. Account setup and access

4.1. Accounts are generally created through in person onboarding or another process managed by Empaco, rather than through self service registration within the App.

4.2. The Client is responsible for ensuring that the information provided for onboarding and access is accurate, complete, and kept up to date.

4.3. Users must keep their login credentials secure and confidential.

4.4. Users must not:

  • –share credentials with unauthorised persons,
  • –allow persons not authorised for the relevant service relationship to access the App through their account,
  • –attempt to bypass authentication, access controls, or security measures.

4.5. You must notify Empaco without undue delay if you suspect unauthorised access, loss of credentials, or any security issue affecting your account or the App.

5. Nature of the App and service

5.1. The App is designed to support connection, visibility, and awareness in relation to the Angelo Life smartwatch and related services.

5.2. Depending on the selected service package and enabled permissions, the App may display or transmit information such as:

  • –selected wellbeing indicators generated by the connected device,
  • –event notifications, including fall related events or similar alerts,
  • –location related information,
  • –device status information,
  • –service and support communications.

5.3. The App is intended solely as a supportive digital tool for visibility, communication, and day to day awareness between the Client, the User, and any Designated Person.

6. Important notice on use limitations

6.1. The Angelo Life App and related services are intended only for informational, indicative, and supportive purposes.

6.2. The App is not intended as a medical device and is not intended to provide medical advice, medical diagnosis, medical treatment, clinical monitoring, or emergency response services.

6.3. The App and any information shown through it must not be used as a substitute for professional medical judgement, professional care, or emergency services.

6.4. Any data, readings, indicators, trends, alerts, or location information made available through the App are provided only to support general awareness and reassurance.

6.5. The information made available through the App must not be relied on:

  • –as a diagnosis,
  • –as treatment advice or a treatment recommendation,
  • –as a basis for starting, stopping, or changing medication,
  • –as a basis for delaying, avoiding, or replacing consultation with a qualified healthcare professional,
  • –as the sole basis for any emergency, safety critical, or health related decision.

6.6. If the User appears unwell, injured, in danger, disoriented, or in need of urgent assistance, the Client or any relevant person must contact the appropriate healthcare professional, emergency service, or other competent responder without delay.

6.7. Users must not delay seeking medical advice or emergency assistance because of information shown in the App, the absence of an alert, a delayed alert, incomplete information, or any technical limitation of the App or device.

6.8. Alerts, notifications, readings, and location information may be delayed, unavailable, incomplete, or inaccurate due to technical limitations, connectivity issues, environmental conditions, device placement, battery level, user settings, network coverage, or other factors beyond Empaco's reasonable control.

7. No emergency intervention or active monitoring

7.1. Empaco does not provide emergency response services through the App.

7.2. Empaco does not actively monitor Users in real time for the purpose of intervening in emergencies.

7.3. Empaco does not undertake to contact emergency services, hospitals, police, family members, or other third parties in response to alerts or information generated by the App or device, unless expressly agreed otherwise in writing.

7.4. Responsibility for reviewing alerts and taking any appropriate action rests with the Client and, where applicable, the Designated Person.

8. User responsibilities

8.1. Users must use the App and connected device responsibly, lawfully, and in accordance with all instructions made available by Empaco.

8.2. The Client and the User must ensure, as applicable, that:

  • –the smartwatch is charged and worn correctly,
  • –the device is used only by the intended User,
  • –the App is installed on a suitable mobile device,
  • –the mobile device has internet access and the necessary permissions enabled,
  • –relevant contact details remain accurate and up to date,
  • –the Designated Person, where used, is properly informed and able to receive alerts.

8.3. The Client remains responsible for ensuring that any person designated to receive alerts is appropriate, informed, and reachable.

8.4. The App and device must not be used:

  • –in a way contrary to Empaco's instructions,
  • –in a way likely to damage the service, App, or device,
  • –in connection with unlawful surveillance or unlawful data sharing,
  • –in a way that misrepresents the App or service as a source of diagnosis, treatment, or emergency intervention.

9. Device, connectivity, and service limitations

9.1. The App depends on technical systems and external conditions that may affect performance and availability.

9.2. These include, without limitation:

  • –device battery level,
  • –hardware condition,
  • –mobile network availability,
  • –wireless connectivity,
  • –mobile operating system compatibility,
  • –internet access,
  • –GPS signal conditions,
  • –local environment and signal interference,
  • –maintenance or updates.

9.3. Empaco does not guarantee uninterrupted, error free, or continuously available service.

9.4. From time to time, the App or service may be limited, suspended, slowed, or unavailable due to maintenance, updates, repairs, security reasons, force majeure, or third party service interruptions.

10. Permissions and mobile device access

10.1. Certain features of the App may require access to functions or permissions on the user's mobile device, such as notifications, location access, Bluetooth, internet access, or similar operating system level permissions.

10.2. If required permissions are refused, disabled, or limited, certain features may not function correctly or may not be available.

10.3. The user remains responsible for the configuration and basic operation of their own mobile device.

11. Notifications and communications

11.1. The App may send service related notifications and alerts, including technical notices, device status information, safety related notifications, account messages, and support related communications.

11.2. The usefulness of such notifications depends on technical conditions and user settings, including internet connectivity, mobile operating system behaviour, notification settings, and battery optimisation settings.

11.3. Empaco is not responsible for missed notifications caused by user settings, connectivity issues, unsupported devices, operating system restrictions, or other circumstances beyond Empaco's reasonable control.

12. Privacy and personal data

12.1. Empaco processes personal data in accordance with applicable data protection law and the Angelo Life App Privacy Notice.

12.2. By using the App, the user acknowledges that personal data may be processed in connection with account management, service provision, alerts, support, security, and legal compliance.

12.3. Users must ensure that they have the necessary authority to provide personal data relating to other persons, including Users and Designated Persons, where applicable.

12.4. Where a Client or another user provides personal data relating to a third party, that person remains responsible for ensuring that such provision is lawful.

13. Intellectual property

13.1. The App, software, interface, content, structure, design, logos, trademarks, databases, technical materials, and all related intellectual property rights belong to Empaco and or its licensors.

13.2. Subject to these Terms and the applicable service relationship, Empaco grants the user a limited, personal, non exclusive, non transferable, revocable right to use the App solely for its intended purpose and only for the duration of the permitted service relationship.

13.3. No ownership rights are transferred to the user.

13.4. The user must not:

  • –copy, reproduce, distribute, publish, license, sublicense, sell, lease, or commercially exploit the App,
  • –modify, adapt, translate, decompile, disassemble, reverse engineer, or create derivative works, except to the extent mandatory law expressly permits such acts,
  • –remove or alter copyright, trademark, or proprietary notices,
  • –use the App to build or support a competing product or service.

14. Prohibited conduct

14.1. The user must not:

  • –use the App unlawfully or fraudulently,
  • –interfere with the security, integrity, or operation of the App or related services,
  • –upload malicious code or attempt unauthorised access,
  • –misuse information relating to the User or Designated Persons,
  • –use the App in a way that infringes the rights of others, including privacy rights,
  • –present the App as a source of diagnosis, treatment, or emergency intervention.

15. Updates and modifications

15.1. Empaco may release updates, fixes, patches, interface changes, or feature changes from time to time.

15.2. The user may need to install updates in order to continue using the App or certain features.

15.3. Empaco may modify, improve, replace, restrict, or discontinue features where reasonably necessary for technical, operational, legal, security, or business reasons.

16. Suspension and termination of access

16.1. Empaco may suspend or restrict access to the App, in whole or in part, where reasonably necessary:

  • –to protect security or system integrity,
  • –in the event of suspected misuse,
  • –for maintenance or updates,
  • –in the event of unpaid fees under the applicable service contract, where relevant,
  • –where the service contract has expired or been terminated,
  • –where continued access would create legal or regulatory risk.

16.2. The right to use the App ends automatically when the relevant contractual relationship, authorisation, or service access ends, unless Empaco expressly states otherwise.

16.3. Upon termination or expiry, the user must cease using the App except to the extent continued access is expressly permitted by law or by Empaco.

17. Fees and contractual charges

17.1. The App may be made available as part of a broader paid service package involving the device, SIM subscription, monitoring related services, and associated support.

17.2. Any fees, billing intervals, annual or monthly options, price adjustments, penalties, return related charges, or related commercial matters are governed by the separate service contract and its annexes.

17.3. Nothing in these Terms limits any payment obligations validly agreed in the separate service contract.

18. Warranties and disclaimers

18.1. To the maximum extent permitted by applicable law, the App is provided on an as available basis.

18.2. Empaco uses reasonable professional care in providing the App, but does not guarantee that:

  • –the App will always be uninterrupted or error free,
  • –all alerts or data will always be timely, accurate, complete, or available,
  • –the App will prevent harm, illness, falls, emergencies, or injury,
  • –the App will detect every relevant event or condition,
  • –the App is suitable for diagnosis, treatment, or clinical decision making.

18.3. Any examples, descriptions, onboarding explanations, educational materials, or support materials are provided for general explanatory purposes only and do not create a guarantee of outcome.

19. Limitation of liability

19.1. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

19.2. Subject to clause 19.1, Empaco shall not be liable for any loss, damage, injury, delay, missed event, missed alert, inaccurate reading, or service interruption arising from:

  • –misuse of the App or device,
  • –failure to follow instructions,
  • –failure to charge, wear, connect, or correctly configure the device or App,
  • –lack of network coverage, internet access, GPS signal, or connectivity,
  • –external service failures or force majeure,
  • –reliance on the App or device as a substitute for medical care, professional judgement, or emergency services,
  • –failure by the Client or Designated Person to review alerts or take appropriate action.

19.3. To the extent permitted by law, Empaco shall not be liable for indirect, consequential, incidental, special, or punitive damages, including loss of opportunity, distress, loss of data, or loss resulting from delayed, missed, incomplete, or inaccurate information.

19.4. Where a separate signed contract governs liability in greater detail, that contract shall prevail.

20. Consumer rights

20.1. Nothing in these Terms limits any mandatory rights that a consumer may have under applicable Romanian or European Union law.

20.2. Where the user is a consumer, these Terms shall be interpreted consistently with mandatory consumer protection law.

21. Governing law and jurisdiction

21.1. These Terms are governed by the laws of Romania.

21.2. Any dispute arising out of or in connection with these Terms shall first be addressed in good faith with a view to an amicable settlement.

21.3. Where amicable settlement is not achieved, disputes shall be resolved by the competent courts in Romania, without prejudice to any mandatory jurisdiction rules applicable to consumers under law.

22. Changes to these Terms

22.1. Empaco may amend these Terms from time to time where necessary for legal, regulatory, technical, operational, or business reasons.

22.2. The latest version of these Terms will be made available within the App and or on the relevant website.

22.3. Continued use of the App after updated Terms take effect constitutes acceptance of the updated Terms, except where mandatory law requires a different approach.
