1. Scope

These Terms of Use (“Terms”) govern access to and use of the website www.empaco.eu (“Website”) operated by Empaco Healthcare Technologies SRL, a company incorporated under the laws of Romania, with registered office at Piața Unirii 3, Timișoara, Romania (“Company”, “we”, “us”). By accessing or using the Website, you (“User”, “you”) agree to be bound by these Terms. If you do not agree, you must not use the Website.

2. Services Provided

The Website presents information regarding our smartwatch and companion application (the “Product”). The Product is not offered for sale directly through the Website. Users may submit their contact details (email and/or phone number) in order to request a demo or further information. The submission of such details does not constitute a binding order or contract of sale.

3. User Obligations

You agree to:

- provide accurate and up-to-date information when submitting contact details; - comply with all applicable laws and regulations; - refrain from interfering with or disrupting the normal operation of the Website; - not upload or transmit viruses, malware, or harmful code; - not use automated systems (including bots, scrapers, or similar technologies) to extract data without authorization; - not post or transmit unlawful, defamatory, obscene, abusive, or otherwise objectionable material through the Website. - We reserve the right to restrict or suspend access to the Website in case of a breach of these Terms.

4. Privacy

The processing of personal data collected through the Website is governed by our separate Privacy Policy, which forms an integral part of the legal framework applicable to your use of the Website.

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes shall be submitted to the competent courts of Romania, without prejudice to mandatory consumer protection provisions granting jurisdiction in your place of residence.

9. ODR Platform

In accordance with Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes, you may access the European Commission’s Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr. We are not obliged and do not commit to use alternative dispute resolution entities to resolve disputes with consumers, but you may use the platform if you are resident in the EU.
